IMPORTANT INFORMATION

The Cartel de Belleville company through its website offers a selection of vintage or renovated furniture dating from the 50s to the 80s. The photographs representing the furniture offered for sale are as accurate as possible but cannot ensure perfect similarity with the product for sale. The photographs therefore have no contractual value. This furniture has, even after careful restoration, traces, impacts, marks and scratches from use, and is sold as is, without any guarantee. Moreover, the furniture, in particular that intended for children (beds, toys, etc.), having been manufactured more than 50 years ago, it no longer meets the safety standards in force in France. It may present a risk in the context of use other than decoration. The same is true for old lamps, including the safety of connections, sockets, wires, etc. no longer meets the safety standards in force in France. The site is the property of Cartel de Belleville in its entirety, as well as all the rights relating thereto. Any reproduction, in whole or in part, is systematically subject to the authorization of the owners.

1. PARTS

These conditions of sale are concluded on the one hand between the company Cartel de Belleville, SARL whose head office is located at 3 rue Meissonnier 93500 PANTIN, France, registered in the business directory under the number: 823 859 095 00015 ( hereinafter referred to as "Cartel de Belleville") and on the other hand, any natural or legal person wishing to make a purchase via the "" website (hereinafter referred to as "the customer").

2. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

The customer acknowledges having read, at the time of placing the order, these general conditions of sale.

These products are offered within the limits of available stocks and "Cartel de Belleville" is in no way responsible if stocks run out.

The catalog of our products can constantly evolve. Each product is accompanied by the most precise description possible.

The photographs, the exclusive property of "Cartel de Belleville", are as accurate as possible but cannot ensure perfect similarity with the product offered for sale, in particular with colors and materials. The photographs are used for illustrative purposes only within the limits of the technique and the best standards of the market. The photographs have no contractual value. If errors are introduced, in no case, the responsibility of "Cartel de Belleville" can not be engaged.

The products offered for sale are not new and have already been used. Consequently, it is normal for them to show signs of wear, scratches, chips or other defects due to their age.

4. ORDER TERMS

All orders are made via the website "www.carteldebelleville.com". Confirmation of the order entails acceptance of these conditions of sale, acknowledgment of having full knowledge of them and waiver of the right to invoke its own conditions of purchase or other conditions. All the data provided and the recorded confirmation will serve as proof of the nature, content and date of the transaction. Confirmation will be worth signing and acceptance of transactions. The sale will not be definitively concluded until payment of the order. "Cartel de Belleville" will only be committed to executing the order after acceptance of the customer's order, confirmed by an email sent to the address that the customer has communicated to us, and full payment of the sale price. 5. PAYMENT TERMS

The customer can pay by bank transfer, either via Paypal by credit card bearing the acronym CB or by Paypal account. Paypal allows you to pay via a server in a secure environment. The order validated by the customer will only be considered effective when the bank payment center concerned has given its agreement. "Cartel de Belleville" will issue an invoice which will be attached to the package containing the order if the billing address is identical to the delivery address. 6. DELIVERY TERMS

6.1 Hand delivery

6.2 Delivery by carrier in France outside Paris & Ile de France

Cartel de Belleville will offer the customer a delivery rate by carrier. The customer will obviously be free to accept or not. Cartel de Belleville declines all responsibility in the event of damage caused to the goods during transport.

Carriers are not required to deliver inside the home Delivery is made at the foot of the home (building or house). In the event of absence on the day of the carrier's visit, the latter will leave a transit advice note at the address indicated, specifying his contact details in order to contact him again to arrange another appointment.

Any delays in delivery do not entitle you to claim damages. In any case, the product travels at your own risk. Upon receipt of the product, it is the customer's responsibility to check the package. 6.3 Sending by Colissimo or Mondial Relay

"Cartel de Belleville" undertakes to ship all items ordered by the customer within 7 working days for products delivered by Colissimo and Mondial Relay. This deadline can be given for information by email. Exceeding them cannot justify the cancellation of your order without our prior agreement. For products shipped outside the European Union, the customer agrees to pay all taxes due on the importation of products, customs duty, value added tax, and all other taxes due under the laws of the country of receipt of the command. All orders placed with "Cartel de Belleville" are intended for the personal use of customers. Customers or recipients of the products are prohibited from any partial or total resale of the products. "Cartel de Belleville" de facto disclaims any legal liability if the payment of taxes was not made by the customer. Any delays do not entitle the buyer to claim damages. The buyer is delivered to his home or to a relay point. In case of absence, the buyer or the recipient of the ordered product receives a delivery notice from La Poste or an SMS from Mondial Relay to notify him of the arrival of his package, which allows him to collect the ordered products, at the nearest post office or relay point, during a given period. The buyer is required to check, in the presence of the delivery person, the condition of the packaging of the goods and its contents on delivery. In the event that the buyer has any doubt of any kind whatsoever about the condition or content of his package, he is required to apply the Colissimo and Mondial Relay procedure (in particular to report the damage observed, any complaints and reservations) and to refuse the goods by immediately issuing a finding of anomaly. The customer is also required to report these incidents to the seller within 48 hours by attaching a duplicate of the anomaly report made with La Poste or Mondial Relay.

7. QUALITY AND COMPLIANCE ISSUE

In the event of delivery of a product that does not correspond to the order (defective or non-compliant), the customer must make his complaint within 48 hours from the date of receipt of the package. Complaints must be sent by email to hello@carteldebelleville.com.

Complaints must include: the buyer's contact details, product references, proof of payment, reasons for the complaint and all supporting documents. The return of products must be made within seven working days. Failing this, Cartel de Belleville will not exchange or refund the products thus ordered.Any product to be exchanged or refunded must be returned to "Cartel de Belleville" as shipped, in its original condition and packaging and include all of the product and its accessories

Shipping costs are the responsibility of "Cartel de Belleville", except in the case where the returned or exchanged product does not correspond to the original declaration made by the buyer in the return form. Coverage of these return costs will be capped at the rate corresponding to the Colissimo shipment. Any risk related to the return of the product is the responsibility of the buyer. In the absence of non-compliance with the procedure set out above and the deadlines involved, the buyer may not make any claim for non-compliance or apparent defect of the products delivered, the products then being deemed to be compliant and free from any apparent defect.

8. PRODUCT AVAILABILITY

The products presented on the website are offered within the limits of available stocks. In case of unavailability of the product ordered, "Cartel de Belleville" will inform the buyer as soon as possible.

The buyer will be reimbursed without delay and at the latest within 30 days of payment of the sums he has paid.

9. RIGHT OF WITHDRAWAL

In accordance with Article L 121-16 of the Consumer Code, the customer has a period of seven clear days from the date of receipt of the items to return, at his own expense, the products ordered for reimbursement . The products must imperatively be returned in perfect condition for resale, in their original condition (packaging, accessories, instructions for use and documentation), duly sealed and accompanied by the invoice corresponding to the purchase. 10. PRICE OF PRODUCTS

The prices displayed online are guaranteed, unless, in particular due to an error or a technical problem, they are abnormally low. The price is expressed in euros on the website individually in euros, all taxes included, VAT not applicable under article 293 B of the CGI, and corresponds to the price in force on the day of the order. The price applicable to the order is the price indicated on the product sheets, on the day of confirmation of the order.

The price does not include shipping costs, invoiced in addition to the price of the products purchased according to the amount of the order. In return, "Cartel de Belleville" will offer a delivery quote as soon as possible. The price of the products is payable in cash on the day of the actual order.Payment is made by check, transfer or cash on delivery. Furthermore, Cartel de Belleville reserves the right to refuse any order from a customer.

11. APPLICABLE LAW - DISPUTES

These general conditions of sale are subject to French law.

In the event of a dispute, the customer must first initiate a request for amicable settlement before any legal action.

"Cartel de Belleville" cannot be held responsible for damage of any kind, whether material, immaterial or bodily, which could result from a malfunction or misuse of the products marketed. The liability of "Cartel de Belleville" will, in any case, be limited to the amount of the order and cannot be blamed for simple errors or omissions which may have persisted despite all the precautions taken in the presentation of the products. Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer will contact "Cartel de Belleville" to obtain an amicable solution.

In the absence of an amicable settlement, the Tribunal de Grande Instance of Paris will have jurisdiction.

12. GUARANTEES

In all cases, "Cartel de Belleville" cannot be held responsible for non-compliance with the regulations and laws in force in the receiving country. Cartel de Belleville's liability is systematically limited to the value of the product in question, value on its date of sale, and this, without the possibility of recourse to Cartel de Belleville or the company producing the product.

13. LEGAL INFORMATION

It is mandatory to provide the personal information collected for the purposes of distance selling, as this information is essential for the processing and delivery of orders, the preparation of invoices and warranty contracts. 14. RETENTION OF OWNERSHIP

"Cartel de Belleville" retains full ownership of the products sold until full payment of the principal price, including costs and taxes. During the period from delivery to transfer of ownership, the risk of loss, theft or destruction is the responsibility of the buyer.

Non-performance by the customer of his payment obligations gives Cartel de Belleville the right to demand the immediate return of the goods delivered at the expense and risk of the buyer.
